Prosecution Appeals Not Guilty Ruling Of Park Yoochun’s Accuser, Claims “Rape Cannot Happen In A Small Bathroom”

Early July 2017, Ms. Song, the woman who had accused JYJ’s Park Yoochun of sexual assault in 2016, was found not guilty of false accusation and defamation by a unanimous jury vote.

The following week, the ruling was appealed by the prosecution.

The first trial of the appeal was held on the morning of September 5, where the prosecution revealed their reason for the appeal: “Although the initial trial resulted in a unanimous jury vote of ‘not guilty,’ it’s not possible for rape to occur in a small bathroom; what happened was that [Park Yoochun] did not give [Ms. Song] his number after having consensual intercourse, so she falsely accused him of rape.”

On September 21, Seoul's High Court held a trial to determine whether female A, under trial for alleged false sexual assault accusations against JYJ's Yoochun, was innocent or guilty.

The High Court's verdict was that A was innocent due to lack of evidence to support the claim that the accused pressed completely false charges. Afterward, the involved parties attended a press conference, during which A continued to assert that Yoochun raped her. A's lawyer also revealed that they have submitted A's previous sexual assault charges for re-evaluation.

On September 21, the second accuser in Yoochun's sexual assault case held a press conference following the trial at Seoul's High Court.

The accuser identified as Bmade an appearance with her legal representative and opened up about her painful experience.

B stated, "After having unwanted sexual intercourse, my whole body ached and I just wanted to go home so bad. At the thought of no one believing me, I even thought it would be better for me to burn coal briquette, commit suicide, and let the investigation go on after they find my cell phone."
