Efforts for an agreement between SM Entertainment and Kris and Luhan fall through

Previously, in the cases of SM Entertainment versus former EXO members Kris and Luhan, the two sides were forced by the court to arbitrate in the hopes of reaching a favorable agreement, but it seems SM Entertainment has had enough.

According to a report on June 5 by Star News, SM Entertainment raised an objection to the decision for compulsory arbitration at the Seoul Central District Court, saying that they could not accept it. The reasons for SM Entertainment"s formal objection have not been revealed.

A compulsory arbitration means that in the case an agreement is not reached by the disputing parties, the court will by official authority force an arbitration through conditions for reconciliation. If one side raises an objection within two weeks, then the reconciliation would fail to be established and the parties will move onto a lawsuit.

As neither Kris nor Luhan raised objections to this, SM"s side did so, refusing to accept the terms, so an agreement between the parties has now fallen through. Stay tuned.

No Agreement Reached Between Luhan and SM Entertainment during First Mediation

No Agreement Reached Between Luhan and SM Entertainment during First Mediation

Luhan and SM Entertainment End First Mediation in 30 Minutes without Reaching Agreement

On December 16th, Luhan and his former management agency SM Entertainment have attended the first court-referred mediation conference. The two parties have been invited to the court on today to reconcile and make arrangements for Luhan’s contract termination with SM Entertainment instead of having the court make those decisions for them.

The lawsuit was first filed against SM Entertainment earlier this year in October, before it was forwarded to arbitration under court order last month. While Luhan nor SM Entertainment’s CEO Kim Young Min were present, each of their representative attorneys met for the first time in order to try to reach an agreement.

It is reported that the mediation ended after just 30 minutes, as the two sides were unable to work out a compromise, and only listened to the other side’s position. With an unsuccessful first round, the case will enter its next round, which has not yet been scheduled.

However, this was not an unexpected outcome, as Kris, who is also in the middle of his ongoing lawsuit with SM Entertainment, was unable to reach an agreement during his second mediation, which resulted in a third round that will be held next year. As both Luhan and Kris are in the same situation, it was very unlikely that Luhan would be successful in working out a compromise as well.
